Post Mortem Ruling

Israel’s High Court handed down a ruling earlier in the week on a case surrounding who can have sex with whom. The affected party, however, has already died.

The deets: According to Hebrew daily Yediot, a prisoner serving a life sentence appealed to the courts two years ago for permission to “hook up” with his partner. The prisoner had AIDS.

The claimant’s claim stated that intimacy is the only humane contact allowed a life termer and there is no justification for legally preventing that contact.

The overseeing judges, however, viewed things differently and ruled that the fair and responsible thing to do was to prevent intimacy in order to safeguard the partner’s health.

The prisoner will never know the outcome – he died two months ago. But the judges went ahead with the ruling because of its potential significance in impacting similar cases in the future.
