Mom Versus Mom

It’s here. It’s a precedent. And in terms of the big picture, it’s a step forward for Israel’s gay rights advocates.

Israel‘s Family Court recently ruled that in the case of a two-mom household that split, the non-biological mom will have to pay child support for their 6-year-old daughter.

“We see this as precedent setting in matters of child support in same sex households,” the attorney representing the defendant told Hebrew press.

The women met 8 years ago and shared house, had a daughter via a sperm donor and raised her as a couple. They shared expenses, both had incomes and they even drew up an agreement stipulating their child would stay with the biological mom and that the non-biological mom would move out should they split.

The women went separate ways and several months ago the biological mom filed for child support. Although mom #2 had never formally adopted her daughter, the court ruled in her ex’s favor.

The ex is incensed over the decision – “If the court sees me as a ‘father’ fit to pay child support,” she told Hebrew press, “then why doesn’t the Interior Ministry allow me to add my child’s name in my I.D. as her mother?”

True. But that, too, shall come about.
